These Terms of Service, together with the Refund Policy and the Acceptable Use Policy, are the agreement between you and Built on Future, LLC for using Future. Please read them. The parts in bold are the ones people ask about most.
1. Who we are and what these Terms cover
These Terms of Service (“Terms”) are an agreement between you and Built on Future, LLC, a Delaware limited liability company (“Future”, “we”, “us”). Our mailing address is in Section 31. You can reach us at support@builtonfuture.com.
The Terms cover your use of builtonfuture.com, the free design previews, the Studio and Builder, hosting, the marketing tools, the help chat, the AI features, the connections to outside AI apps, and anything else we provide (together, the “Service”).
“You” means the person who accepts these Terms. If you accept for a business or other organization, “you” also means that organization, and you confirm you are allowed to bind it.
You accept these Terms when you tick the box or click the button that says so (for example, before your first free designs or at checkout), or when you use the Service. If you don’t agree, don’t use the Service.
Who can use Future. You must be at least 18 and able to form a binding contract. Future is made for businesses, organizations, freelancers and people building a project. By using it you confirm you are using it for one of those purposes and not mainly for personal, family or household purposes.
Where Future is open. Future is offered to people and businesses in the United States and Canada. Free designs aren’t available from other countries yet, and plans can be bought only with a billing address in the United States or Canada.
2. Words we use
- Account: your sign-in and the sites you own or belong to.
- Site: one website on Future, with its pages, settings, marketing tools and team. Each site needs its own plan.
- Studio and Builder: the place where you run your site and the editor where you change it.
- Plan: the paid subscription for one site (for example Starter, Pro or Premier), monthly or yearly.
- Payer: the person whose payment method pays for a site’s plan. Only the Payer can change or pay for the plan, but any owner can close the site.
- Your Content: your words, photos, videos, files, products, blog posts, logos you supply, and anything else you or your team type or upload, plus the words and images our AI makes for your pages at your request (Section 10.1). If you get a refund within the Guarantee Period, images our AI made stop being Your Content (Section 10.1). It doesn’t include the Future Design.
- Customer Data: personal information about your own customers, visitors, contacts, buyers, donors, members and subscribers that the Service collects or stores for your site (for example form answers, contacts, bookings, orders and email consent records).
- Future Design: the designs, layouts, templates, styling, themes and site code that make up how your site looks and works, including the design Future made for you and the changes you make to it in the Builder. It belongs to Future and is licensed to you while you’re subscribed (Section 10.2).
- Design Buyout: the optional paid “Take your design with you” export and license (Section 10.3).
- Preview Materials: what we show you before you pay, such as your three free homepage designs, logo options, tweaks, and “templates made to fit you”.
- Your Logo: the logo Future’s AI made that you pick for your site. Logo Files means the full-quality files of Your Logo that we offer to download in the Studio (high-resolution PNG and SVG). The web-size copy of the logo on your site isn’t a Logo File. Section 10.5 has the logo’s rules.
- AI Features: anything in the Service that uses artificial intelligence to draw, write, build, edit, suggest or answer, including design previews, page building and rebuilds, the Builder’s AI, Describe your site, SEO suggestions, email writing, “From an image”, and the help chat.
- Allowances: the monthly limits of your plan (see Section 6 and Schedule A).
- Guarantee Period: the 15 days after the first payment for a new plan, meaning your first plan with Future (see Section 8 and the Refund Policy).
- Third-Party Services: services run by other companies that work with Future, such as our payment processor, AI model providers, email delivery providers, the domain registrar, Google, and apps you choose to connect.
3. Your account and your team
- Accurate details. Give us true, current details, including a working email address. We may ask you to confirm your email address before we make designs.
- Keep it secure. You are responsible for your sign-in and for everything done in your account. Tell us at once at support@builtonfuture.com if you think someone else got in.
- Your team. You can invite team members with different roles. You are responsible for what your team members do on your site and for removing people who should no longer have access. Team member numbers are limited by your plan.
- Connected apps and agents. If you connect an outside AI app or tool to your site (Section 11.6), anything it does with the permissions you gave it counts as done by you.
- Sites for someone else. If you set up a site for a client or another business, you confirm you have their permission, and you remain responsible under these Terms.
- One free set of designs per business. We may refuse or limit sign-ups, for example to stop people from getting free designs again under new names (see Section 4 and the Acceptable Use Policy).
4. Free previews
Before you pay, Future shows you Preview Materials for free: for example three custom homepage designs, logo options, a few tweaks, and templates filled in with your details.
- For evaluation only. Preview Materials are for deciding whether to buy a plan. Until you buy, you have no license to use them: don’t copy, save, screenshot for use, trace, recreate, publish or host them, or use them for your business. When you buy a plan, we build the design you pick into your site on Future, under the license in Section 10.2.
- Logo previews are low-resolution. Logo options shown before you buy are low-resolution previews so you can choose. They come with no commercial rights: until you buy a plan, don’t use a logo preview (or a copy, trace or recreation of it) on signs, cards, products, social media, a website or anywhere else for your business. Commercial rights and the full Logo Files come with a paid plan (Section 10.5).
- No harvesting. Using the free previews to collect logos or designs without buying a plan isn’t allowed (Acceptable Use Policy, Section 4).
- Limits. Free previews are limited for each person and business, and we may queue requests when demand is high. We may change these limits at any time.
- No promises about previews. We don’t promise any particular number, style or quality of designs. Designs are drawn for you, but similar designs may be made for others.
- What happens to previews you don’t buy. We keep Preview Materials so you can come back to them, and you can ask us to delete them at any time. If you created an account and didn’t buy a plan, they’re deleted with it (Section 21.4). We never show a design with your business name or details to anyone else without your permission. We may reuse general styles, layouts and ideas from unbought previews.
5. Plans, prices and payment
5.1 Plans
Our current plans, prices and Allowances are in Schedule A and on our pricing page. The price and terms shown to you at checkout are the ones that apply to your purchase.
5.2 Taxes
Prices are shown before tax. Sales tax, GST/HST or similar taxes are worked out from your billing address and added at checkout, and shown before you pay. You are responsible for any taxes on your purchase except taxes on our income.
5.3 Payment
Payments are processed by our payment processor, Stripe. You enter your card or other payment details on Stripe’s pages, not ours; we never see or store your full card number. By paying, you authorize us (through Stripe) to charge your payment method for the plan you chose, any add-ons, and any taxes, now and at each renewal.
5.4 Automatic renewal
Plans renew automatically at the end of each billing period (each month or each year) at the then-current renewal price for your plan, plus tax, until you cancel. You can turn renewal off online at any time in your site’s Studio under Settings → Your plan. Turning renewal off stops future charges; your plan stays active until the end of the period you already paid for.
- Before a yearly plan renews, we email the Payer at least 30 days before the renewal date with the amount, the date, that renewals aren’t refundable, and how to cancel before that date.
- Monthly plans renew each month without a separate reminder.
5.5 Founding prices
For sign-ups from 12 October 2026 through 11:59 p.m. US Central Time on 7 November 2026, new yearly Pro and Premier plans get a founding price (Schedule A). The founding price:
- applies only to Pro and Premier plans billed yearly and paid up front, started by that deadline;
- stays the same at every yearly renewal for as long as your plan stays active, unless you change it as described below;
- does not apply to monthly plans, to Starter, or to plans started after the deadline;
- is lost if your plan is canceled, ends unpaid (Section 5.7), is refunded, or you switch to monthly billing or to a different plan. The new plan or billing period is at its regular price, and a later purchase is at the price in effect then;
- comes with the same Allowances and limits as the regular plan.
5.6 Price changes
We may change our prices. A change does not affect a period you have already paid for. For an existing plan, we will tell the Payer by email at least 30 days before a higher price applies at your next renewal, and you can cancel before then.
5.7 Failed payments
If a payment fails, we’ll email you and keep your site running for 7 days while you update your payment method (we remind you before the 7 days end). If it is still unpaid after that, we pause your site: visitors see that it is paused, but you can still sign in to pay, export Your Content, or close it. Paying lifts the pause.
5.8 Add-ons and Coming soon features
Some extras are sold separately (add-ons) at the price shown when you buy them. Features marked “Coming soon” are not part of what you pay for today; we may add them later, change them or not release them. Buying a plan because of a Coming soon feature doesn’t entitle you to a refund outside the Refund Policy if it’s late or never comes.
5.9 Promotions
We may offer discounts, promotions or invitation prices. Each one has its own conditions shown with it, can’t be combined unless we say so, and has no cash value.
6. Allowances, caps and fair use
6.1 Allowances are hard limits
Each plan has monthly Allowances, listed in Schedule A: AI use, new designs, site rebuilds, marketing emails, pages, file storage, team members, running automations and (when available) text messages. They are hard limits. When you reach one, that feature stops until the next month (or until you upgrade or, where we offer it, buy more). Everything you already have keeps working: we don’t delete pages, files or contacts because you reached a limit.
6.2 Monthly reset
Monthly Allowances reset at the start of each calendar month in Coordinated Universal Time (UTC). Unused amounts don’t carry over and have no cash value. New designs, rebuilds and other design credits are for use on Future while you’re subscribed (Section 10.6).
6.3 The AI allowance
Each site gets a monthly AI allowance for the AI Features it uses (for example the Builder’s AI, Describe your site, SEO suggestions, email writing and “From an image”). We measure it by what the AI work actually costs us, and we show it to you in plain words, for example “AI this month: about 40 more changes”. For the first 30 days after your site’s first build, the allowance is twice the monthly amount. We may stop an AI request part-way when the allowance runs out; changes already made stay. New designs and rebuilds have their own counts (Schedule A).
6.4 When you reach a limit
You can upgrade to a bigger plan, wait for the next month, or, where we offer them, buy top-ups. You can also connect your own outside AI app to keep working (Section 11.6); that app’s use is under your agreement with its provider.
6.5 “Unlimited” means fair use
Where we say “unlimited” (for example forms and contacts, or automations on Premier), normal use by one small business is unlimited, but the fair use rules in the Acceptable Use Policy apply. If your use is far above normal and puts the Service or other customers at risk, we will usually contact you first and may limit it, ask you to change plans, or, in serious cases, act under Section 20.
6.6 Changing plans
- Upgrading takes effect when the payment for the difference goes through.
- Downgrading keeps your pages, products, orders, bookings, contacts and other data, but features your new plan doesn’t include stop taking new use, and new invitations or sends wait until you are within the new plan’s limits. Changing plans doesn’t reset this month’s use.
- Switching from yearly to monthly takes effect right away. The unused part of your yearly payment becomes a credit on your account for future charges, not cash. If you claimed a free domain in that paid year, its cost is charged with the switch (the domain stays yours). A founding price ends when you switch.
7. Canceling, closing and coming back
- Cancel renewal online at any time in Settings → Your plan. Your site stays live until the end of the period you paid for. After the 15-day Guarantee Period, payments are not refunded for unused time, except as the Refund Policy says or the law requires.
- Close your site in Settings → Your plan → Close my site. Before you close, we offer you an export of your content (Section 21). Closing ends the plan at the end of the paid period.
- What happens after the plan ends is in Section 21.
- Coming back. You can pick a plan again while your site is still kept (Section 21). It will be at the price in effect then.
8. The 15-day money-back guarantee
If you are not happy with a new plan (your first plan with Future), ask within 15 days of its first payment, and we will refund that payment minus the cost of any domain you claimed with it (the domain stays yours). Nothing else is kept back: what you used or downloaded (for example AI work, designs, page builds and rebuilds, the Logo Files or your content export) doesn’t change your refund.
The guarantee covers the first payment for a new plan. Upgrades, add-ons, top-ups, domains and renewals aren’t refundable. An upgrade or other plan-change charge is never refunded, even one paid during the 15 days, and even though a refund ends the plan. The guarantee applies once per customer and business, so a plan for another site isn’t a new plan. Separately from the guarantee, an add-on’s set-up fee for work we haven’t started is refunded in full (Refund Policy, Section 8).
The refund never comes to more than you paid, and it goes back to your original payment method. When we refund, your plan, your license to the Future Design, and your rights to Your Logo and to the images our AI made for your pages end, and your site goes offline when the refund is processed. Your Content stays yours, and you can export it for 30 days: after a refund, that means what you added yourself (Section 21.3). Any copy of the design kept elsewhere without a Design Buyout is unlicensed (Section 10.4). We may refuse or reduce a refund for abuse, fraud, chargebacks, excessive or automated use, or breaking the Acceptable Use Policy.
The full rules, examples and exceptions are in the Refund Policy, which is part of these Terms.
9. Your Content and your customers’ data
9.1 Yours to keep
You own Your Content and your Customer Data. Your domain, your words, photos, products and posts, and your customers’ details are yours. We don’t claim ownership of them, we don’t sell them, and you can export them at any time while you have a plan and for 30 days after it ends (Section 21). Your content isn’t locked in. The site’s design is Future’s and works on Future (Section 10.2), unless you buy the Design Buyout (Section 10.3).
9.2 What you let us do with it
You give Future a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, transmit, adapt (for example resize images or reformat pages for phones), back up and send Your Content and Customer Data, only as needed to provide, secure and support the Service for you, including sending it to Third-Party Services that help us do so (for example to an AI provider when you ask the AI to edit a page, or to an email provider when you send a campaign). This license ends when Your Content is deleted from the Service, except for copies in backups until they expire, and anything you’ve published that others have already shared.
If you give us permission (for example to show your site in our gallery), we may use your site as an example. We will not do that without your permission.
9.3 Your promises about Your Content
You confirm that you have all the rights you need in Your Content (including photos, logos, music, fonts, reviews and testimonials you add) and that your use of it on Future doesn’t break the law or anyone else’s rights.
9.4 Your customers’ data: you are in charge, we process it for you
For Customer Data, you are the business in charge of it (the “controller” or “business” under privacy laws), and Future acts as your processor or service provider: we process it only to run the Service for you and on your instructions, as these Terms and our Privacy Policy describe. If you need a data processing agreement, write to us at support@builtonfuture.com. You are responsible for:
- having a lawful basis and any consent you need to collect and use Customer Data;
- telling your visitors and customers what you collect, in a privacy notice on your site (Future can draft one for you to review, Section 12.2);
- answering your customers’ requests to see, correct or delete their data (the Studio gives you tools to do this);
- what you, your team and your connected apps do with Customer Data.
We use Third-Party Services (sub-processors) to run the Service. Our Privacy Policy lists them by kind, we’ll give you the full list if you ask, and we will give 30 days’ notice of new ones.
9.5 Data we use for ourselves
We may use information about how the Service is used (for example counts, timings, errors and costs) to run, secure, support and improve Future, and we may use aggregated or de-identified data that doesn’t identify you or your customers. Our Privacy Policy explains how we handle personal information about you as our customer.
9.6 Backups
We back up the Service daily to protect against loss. Backups are for restoring the Service, not a guaranteed way for you to get back something you deleted. Keep your own copies of anything important (for example by exporting your content).
10. Your content, Future’s design, and your logo
10.1 Your content is yours
Your Content belongs to you: your words, photos, products, blog posts, files and other content, and your Customer Data and your domain. Where our AI helps you write the words on your pages, or writes them at your request, Future assigns to you whatever rights we have in them, and they are part of Your Content: words you wrote with AI help are still your words. Where our AI makes photos or images for your pages at your request, Future assigns to you whatever rights we have in them too, and they are part of Your Content, except that if you get a refund within the Guarantee Period, your rights in them end with the refund and they’re left out of your content export, as Your Logo is (Sections 10.5 and 21.3). Photos, files and products you uploaded yourself always stay yours. You can export Your Content at any time while you have a plan, and for 30 days after your plan ends (Section 21).
10.2 The design is Future’s, licensed to you while you’re subscribed
The Future Design (the designs, layouts, templates, styling, themes and site code that make up how your site looks and works, including the design Future made for you and the changes you make to it in the Builder) and the platform belong to Future.
While your site’s plan is active and paid, Future gives you a non-exclusive, non-transferable license to use, change and publish the Future Design for your site, on Future. You may not:
- copy, download, export, scrape or save the Future Design or site code to use elsewhere;
- host it, or a copy or close imitation of it, on another platform or server;
- resell, sublicense or give it to anyone, or make templates from it;
except with the Design Buyout (Section 10.3).
The license ends when your plan ends, including by cancellation, non-payment or a refund. Your site then goes offline (Section 21), and Your Content stays yours to export.
10.3 “Take your design with you” (Design Buyout)
When we offer it, you can buy a Design Buyout for a site with an active paid plan, for the one-time fee shown when you buy it. You then get:
- a full-site export of your site’s design (its pages, styling and site code, with Your Content); and
- a permanent, non-exclusive license to host and use that design for your own business’s site, on any host, even after your plan ends.
The Design Buyout doesn’t let you resell the design, offer it as a template, or use it for another business. Fonts, stock images and other third-party material in the export come under their own licenses, which the export names.
10.4 Copies of the design elsewhere
Any copy of the Future Design hosted or used outside Future without a Design Buyout is unlicensed (for example a copy made by saving your published pages). You must remove it when your license ends or when we ask, and we may send takedown notices to hosts and platforms where such copies appear, where the law allows.
10.5 Your logo
- Before you buy: logo options are low-resolution previews for evaluation only, with no commercial rights (Section 4).
- With a paid plan: you get commercial rights to Your Logo (we assign to you whatever rights we have in it) and you can download the full Logo Files (high-resolution PNG and SVG) in the Studio. If you get a refund within the Guarantee Period, those rights end (next point).
- If you get a refund within the Guarantee Period, your commercial rights to Your Logo end with the refund, as your license to the Future Design does. Nothing is kept back for the logo. After the refund, don’t use Your Logo, or any Logo Files you downloaded, for your business. Your content export after a refund doesn’t include Your Logo; a logo you uploaded yourself is Your Content and stays in it (Section 21.3).
- After the Guarantee Period, Your Logo and its commercial rights stay yours, even if you later cancel. Your Logo is not part of the Future Design.
- No guarantee of uniqueness or trademark. Logos are made by AI. We don’t guarantee that Your Logo is unique, that it isn’t similar to someone else’s logo or trademark, or that it can be registered as a trademark. Similar logos may be made for others. We don’t search trademark records. Before you use a logo widely or apply to register it, do your own search or ask a lawyer.
10.6 Design credits are for use on Future
New designs, rebuilds, extra designs and other design credits in your plan, whether used or not, are for making and changing your site on Future while you’re subscribed. Unused credits have no cash value, don’t carry over after your plan ends, and can’t be used to make designs to take elsewhere. Using free previews or paid credits to collect or harvest designs is not allowed (Acceptable Use Policy, Section 4).
10.7 What else stays Future’s
Future keeps all rights in the Service and everything that isn’t Your Content or Your Logo, including: the Future Design; the Builder and Studio; our templates, section library and design engine; our instructions and prompts; Preview Materials (designs, logo options and templates shown before you buy, except Your Logo once you buy, unless you get a refund within the Guarantee Period); and the “Future” name and logo.
You understand that:
- AI can produce similar results for others. We may make similar designs, styles, layouts or images for other customers, as long as we don’t reuse your logo or your business’s own details.
- Copyright in AI-made material may be limited. In the United States, material made by AI without enough human creative input may not be protected by copyright. We pass on whatever rights we have in what we assign to you, but we can’t promise that anyone owns copyright in a particular logo, image or text, or that you can register it.
10.8 Things you ask Future to make from someone else’s material
If you ask our AI to make something from material you supply (for example “From an image”, or to redraw an existing site or logo), you confirm you have the right to use that material that way. Owning what comes out doesn’t give you rights in the material you put in.
11. AI Features
11.1 How AI works on Future
Many parts of Future use AI models from third-party AI providers. When you use an AI Feature, the information needed for that request (for example your answers, the page you’re editing, or the photo you upload) is sent to the AI provider to produce the result.
11.2 AI makes mistakes: review before you publish
AI output can be wrong, out of date, incomplete, generic, or similar to other content, and it can make up facts (for example prices, services, credentials, awards, reviews or claims). You are responsible for reviewing and approving everything on your site before you publish it, including everything the AI wrote or drew. Publishing a page means you have reviewed it and take responsibility for it.
11.3 Sample content is marked and blocked
New designs include obvious sample content where your own material belongs (for example “A real Google review appears here”, “Client Name”, or a sample phone number). The Builder marks it and won’t publish a page while sample content is still on it. You must replace it with true material of your own, or remove it. Never publish sample reviews, testimonials, results or contact details as if they were real.
11.4 No legal, industry or compliance checks
Future does not check whether your site, claims, offers, licenses, reviews, prices or practices meet the laws or rules for your business or industry, and the AI doesn’t either. That includes, for example, advertising and professional rules for lawyers, doctors, dentists, financial advisers, contractors and real estate agents; health, food and supplement claims; licensing and insurance statements; and accessibility. You are responsible for that (Section 12).
11.5 Not professional advice
The help chat, the Builder’s AI and any drafts we make (including legal page drafts) are not legal, tax, financial, medical or other professional advice.
11.6 Connecting outside AI apps
You can connect outside AI apps and assistants to your site so they can read or change it with the permissions you choose. Those apps are Third-Party Services under their own terms and their own costs. What a connected app does with the access you gave it counts as your action. You can see and remove connections in the Studio. Use of a connected app doesn’t count against your AI allowance, but we may limit how often any app can make changes.
11.7 AI limits and safety
We may block, change or refuse AI requests or outputs that break the Acceptable Use Policy, that look automated or abusive, or that a provider refuses.
12. Your responsibilities for your site and your business
12.1 What your site says and sells
You are responsible for your site and your business, including:
- that everything on your site is true and not misleading: services, prices, claims, credentials, licenses, insurance, guarantees, before-and-after photos, results and availability;
- reviews and testimonials: only publish real ones, don’t write fake reviews, don’t pay for or hide reviews in ways the law or the review platform forbids, and follow the review platform’s rules (for example Google’s) when you show or request reviews;
- licenses, registrations and permits your business needs, and any industry, professional or advertising rules you’re under;
- the rights to everything you publish (Section 9.3);
- accessibility of your site for people with disabilities, to the extent the law requires it of you;
- age limits for anything age-restricted you offer, and not directing your site at children under 13 unless you comply with children’s privacy laws.
12.2 Privacy notices, cookies and legal pages
You must give your visitors any privacy notice, cookie notice, terms or other notice the law requires. Future can draft a privacy policy, terms, cookie policy and accessibility statement from your answers, and can show a cookie banner when your site needs one. Those drafts are a starting point, not legal advice: have them checked, fill in every part in [square brackets], and publish them only when they are right for your business.
12.3 Email marketing
When you send marketing emails through Future you must follow the law that applies to you, including the US CAN-SPAM Act and, where it applies, Canada’s Anti-Spam Legislation (CASL) and consent laws in other places. In particular:
- only email people who agreed to hear from you or with whom you otherwise have a lawful basis; don’t use bought, rented or scraped lists;
- use your real business name and a valid physical postal address in each marketing email;
- don’t use misleading subject lines or sender names;
- honor unsubscribes (Future adds an unsubscribe link and keeps a list of people who said no; don’t work around it).
12.4 Text messages
Texts from Future. When someone opts in, Future sends text messages under its own name. A person who books with a business that uses Future and ticks the box to get texts receives confirmations, reminders and changes about that booking (up to 4 per booking). A Future customer who turns on text alerts in Settings receives alerts about their own site and account, such as a new message, lead, booking or order. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages. Opting in is never a condition of booking or buying. How we handle mobile numbers is in our Privacy Policy.
Texts you send. Texting from your own business number is not available yet. When it is, you must get each person’s prior express written consent before sending marketing texts and follow the Telephone Consumer Protection Act, carrier rules and quiet hours, and honor STOP requests. Additional terms and registration may apply then.
12.5 Selling, bookings, gift cards and donations
If you sell through your site (the Shop, bookings with deposits or no-show fees, tickets, stays, gift cards or donations):
- you are the seller. Your contract for each sale is between you and your buyer; Future is not a party to it;
- you set and honor your own prices, refund and cancellation policies, deposit and no-show terms, shipping times, warranties and gift card terms, and you handle your buyers’ questions, complaints, returns and disputes;
- you are responsible for taxes on your sales (Future can calculate tax with your payment account’s tools based on your settings and registrations, but you are responsible for registering, collecting and filing), for shipping and for any product-safety, labeling or consumer laws;
- gift cards and donations have special rules in many places (for example on expiry dates, fees, unclaimed balances and charitable solicitation registration): following them is your responsibility.
13. The Shop and payments to you
- Your own Stripe account. To sell, you connect your own Stripe account. Your buyers’ payments go straight to your Stripe account; they don’t pass through Future. Your use of Stripe is under your agreement with Stripe (the Stripe Services Agreement), and Stripe’s fees are yours.
- Platform fee. Future charges a 0% platform fee on Shop sales on every plan at launch.
- Future fees may change. We may introduce or change platform, transaction or payment-related fees in the future. If we do, we will tell you by email at least 30 days before the change applies to you, and any new or higher fee will apply only to sales made after it takes effect, never to past sales. You can stop using the Shop or cancel your plan before the change applies.
- Refunds and disputes for your sales are handled through your Stripe account and come out of your balance. Future’s tools to issue refunds act on your account at your instruction.
- Stripe can refuse or limit your account under its own rules (for example for businesses Stripe doesn’t support). Future can’t override that.
14. Domains
- Your own domain. You can connect a domain you already own. You keep control of it at your registrar; you must keep it registered and renewed.
- Free domain for the first year (Coming soon). When available, yearly plans include one domain registration for the first year. The domain is registered in your name and stays yours, including if you later ask for a refund (we keep back its cost; see the Refund Policy) or switch to monthly (its cost is charged with the switch). After the first year, renewing it is up to you, at the registrar’s price. Domain registration is also under the registrar’s terms and domain-name rules (including the obligation to give accurate contact details).
- After your plan ends, we disconnect your domain from Future (Section 21). That doesn’t change who owns the domain.
15. Email sending
- Emails from your site (form alerts, booking emails, receipts, marketing emails) are sent through Future’s email delivery providers, from an address on your domain once you set it up, or from a Future sending address before then.
- To protect delivery for every customer, we may pause or limit sending from a site with high bounce, complaint or spam-trap rates, unusual volumes, or content that breaks the Acceptable Use Policy, and we will tell you why.
- We keep a list of addresses that unsubscribed or bounced and won’t send marketing to them. Marketing emails count against your monthly Allowance; the emails your site needs to work (such as booking confirmations and receipts) don’t.
16. Third-Party Services
Future works with Third-Party Services, including Stripe (payments for your plan and for your Shop), AI model providers, email delivery providers, a domain registrar, Google (for example Google reviews and maps), security and hosting providers, and any app or tool you choose to connect (for example an outside AI app, a booking tool or an email list service).
- They are run by other companies under their own terms and privacy policies. Where you have to accept their terms (for example Stripe’s for your Shop), you are responsible for doing so and following them.
- We are not responsible for Third-Party Services, their availability, or changes they make. If one changes or stops, we may have to change or stop the feature that depends on it.
- Names of other companies’ products are their trademarks; Future isn’t affiliated with or endorsed by them unless we say so.
17. Acceptable use
You must follow the Acceptable Use and Fair Use Policy, which is part of these Terms. In short: no illegal, harmful, deceptive or infringing content; no spam; no abuse of the AI Features, the free previews, the money-back guarantee or the Service; and fair use of anything “unlimited”.
18. Help and support
- Help chat. The Studio’s help chat answers questions using our help articles and your site’s settings. It is an AI assistant, and it can be wrong; check important answers.
- A person. You can ask for a person from the help chat, or email support@builtonfuture.com. We aim to reply within 1 business day (US Central Time, Monday to Friday, excluding US federal holidays). On Premier, we aim to reply the same business day for requests received by 3:00 p.m. Central. These are goals, not guarantees.
- We don’t provide support for Third-Party Services, your custom code, or sites copied from Future to other hosts.
19. Availability and changes to the Service
- As is. We work hard to keep Future fast and available, but we don’t promise any particular uptime and the Service may sometimes be slow, interrupted or unavailable, including for maintenance, updates, attacks, or problems with Third-Party Services.
- Changes. We improve Future all the time. We may add, change or remove features. If we remove a major feature that is part of your paid plan, we will tell you in advance where we reasonably can, and if it materially reduces what you paid for, you may cancel and ask for a prorated refund of the unused prepaid time.
- Beta and Coming soon features may be incomplete, change, or be withdrawn, and are provided as is.
- Security. We use reasonable technical and organizational measures to protect the Service and your data, but no system is perfectly secure. If we learn of a security breach affecting your data, we will tell you as the law requires. To report a vulnerability, write to support@builtonfuture.com.
20. Suspension and termination
20.1 By you
You can cancel renewal or close your site at any time (Section 7).
20.2 By us
We may suspend or limit your account, a site, or a feature, or close your account or site, with or without notice depending on how serious it is, if we reasonably believe that:
- you haven’t paid (Section 5.7);
- you broke these Terms or the Acceptable Use Policy;
- there is fraud, a stolen payment method, or identity misuse;
- there is chargeback abuse (for example disputing a payment instead of asking us for a refund, or disputing a legitimate charge);
- there is refund abuse (for example asking for refunds repeatedly, or under new accounts or business names);
- you harvest designs or logos from free previews or paid credits, or copy or host the Future Design outside Future without a Design Buyout;
- there is excessive or automated use (bots, scripts, or use far beyond normal for one business) or attempts to get around Allowances or free-preview limits;
- your site or use puts the Service, other customers, visitors or Future at legal, security or reputational risk; or
- the law, a court, a regulator or a Third-Party Service requires it.
Where it is reasonable, we will tell you first and give you a chance to fix the problem. We may act immediately where there is a legal requirement, a security or abuse emergency, illegal content, or fraud.
20.3 What happens then
- During a suspension, you can usually still sign in to pay, export Your Content and Customer Data, or close your site.
- If we close your account or site because you broke these Terms, you are not entitled to a refund.
- If we close the Service or your account without cause, we refund any prepaid fees for the unused time.
- If you dispute a payment with your bank: we may pause the site while the dispute is open, and if we lose a dispute about a legitimate charge we may stop new publishing 7 days after we tell you, and close the account.
21. After your plan ends: exports and deletion
21.1 Exporting your content
Every plan includes a content export, at any time, and for 30 days after your plan ends (including after a refund). It includes Your Content in common formats: page text, images, products, blog posts and other entries, your contacts as a spreadsheet, and form answers. After a refund, it carries only what you added yourself, without Your Logo or the images our AI made (Section 21.3). Exporting your content never affects a refund. Some things don’t come out, such as payment records, passwords and staff notes; the export’s README says which. Only a site owner can start an export.
The content export doesn’t include a license to the Future Design (layouts, styling, templates or site code). A full-site export of the design that you may use elsewhere comes only with the Design Buyout (Section 10.3). The full Logo Files are a separate download (Section 10.5).
21.2 When a plan ends (not a refund)
When a paid plan ends (you closed the site, didn’t renew, or the plan ended for non-payment):
- your site stays online for 30 days, then your license to the Future Design ends, your site goes offline, and your custom domain is disconnected from Future (you still own it);
- you can still sign in to export Your Content, or pick a plan again, for 30 days after the plan ends;
- after that, we delete your site and its content and Customer Data within 60 days, except as listed in Section 21.5. Copies in backups are deleted as the backups expire, within 120 days after that.
21.3 When a plan is refunded
A refund ends the plan and the design license, your site goes offline when the refund is processed, and your custom domain is disconnected from Future (you still own it). Your Content stays yours: you can sign in and export it for 30 days after the refund, and then we delete it as in Section 21.2. After a refund, Your Content means what you added yourself: your page text and posts (including words you wrote with the help of our AI), the photos, files and products you uploaded, and your Customer Data (contacts and form answers). Your rights to Your Logo and to the photos and images our AI made for your pages end with the refund (Sections 10.1 and 10.5), so the export leaves them out. A logo or photo you uploaded yourself stays in it.
21.4 Accounts that never pay
If you sign up and don’t buy a plan, we keep your account and previews for 60 days, then delete them. We remind you before then, and after 14 days your Studio becomes read-only.
21.5 What we keep
We keep some records after deletion where we need them for legal, tax, accounting, security or fraud-prevention reasons, or to honor unsubscribes, for example: invoices and payment records, records of what you agreed to, audit logs of account actions, records used to stop repeat free-preview or refund abuse (kept in a form that doesn’t contain your content), and lists of email addresses that must not be emailed again.
22. Copyright complaints (DMCA)
We respect copyright and expect our customers to do the same. If you believe something on a site hosted by Future infringes your copyright, send a notice to our designated agent:
Copyright AgentBuilt on Future, LLC
Austin, Texas
United States
support@builtonfuture.com
Your notice must include what the law requires (17 U.S.C. § 512(c)(3)), including: your physical or electronic signature; the work you say is infringed; the material and where it is (its web address); your contact details; a statement that you believe in good faith the use isn’t authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
If we remove material because of a notice, we will try to tell the site owner, who may send a counter-notice with the information the law requires (17 U.S.C. § 512(g)). We may restore the material if the complaining party doesn’t tell us within 10 to 14 business days that it has filed a court action.
Repeat infringers. We will close the accounts of customers who repeatedly infringe others’ rights, in appropriate circumstances.
Sending a false notice or counter-notice can make you liable for damages.
23. Feedback and our rules about the Service
- Feedback. If you send us ideas or suggestions, we may use them freely without paying you or owing you anything.
- Don’t take the Service apart. Don’t copy, sell, rent or resell the Service (other than building sites for your own business or with permission under Section 3), copy or host the Future Design or site code outside Future without a Design Buyout (Section 10), reverse engineer it, scrape it, or use it to build a competing product, except as the law allows despite this restriction. The full list is in the Acceptable Use Policy.
24. Future’s name and the “Built on Future” link
- Future, builtonfuture.com, and our logos are our trademarks. You may say your site is built on Future, but don’t use our marks in a way that suggests we endorse you or that confuses people.
- Published sites show a small “Built on Future” link at the bottom. Owners can turn it off in Settings → General.
25. Disclaimers
TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE, PREVIEW MATERIALS, THE FUTURE DESIGN, YOUR LOGO, AI OUTPUT AND EVERYTHING ELSE WE PROVIDE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT. WE DON’T PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT AI OUTPUT WILL BE ACCURATE, ORIGINAL OR LAWFUL, THAT ANY DESIGN OR LOGO IS UNIQUE, IS FREE FROM OTHERS’ RIGHTS, OR CAN BE REGISTERED AS A TRADEMARK, OR THAT YOUR SITE WILL RANK IN SEARCH ENGINES OR AI ANSWERS OR BRING YOU CUSTOMERS. SOME PLACES DON’T ALLOW SOME OF THESE DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.
26. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- FUTURE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, SALES, CUSTOMERS, GOODWILL, DATA OR BUSINESS INTERRUPTION, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND
- FUTURE’S TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FUTURE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR (B) US $100.
These limits apply whatever the legal theory (contract, tort including negligence, or anything else) and even if a remedy fails of its essential purpose. They don’t limit liability that the law doesn’t allow to be limited.
27. Indemnity
You will defend, indemnify and hold harmless Future and its owners, members, managers, employees and contractors from claims, losses, damages, fines, penalties and costs (including reasonable lawyers’ fees) brought by third parties or regulators that arise from:
- Your Content, your site, and what your site says, offers or sells;
- your business and your dealings with your customers, buyers, visitors and team;
- your handling of Customer Data, and your emails and texts (including claims under CAN-SPAM, CASL, the TCPA or privacy laws);
- your use of the Future Design outside Future without a Design Buyout, or of Your Logo without commercial rights (Section 10), or of anything outside these Terms;
- your breach of these Terms or the Acceptable Use Policy, or of the law; or
- anything done through your account or connected apps.
We will tell you about the claim, let you control the defense (we may join with our own lawyer at our cost), and you won’t settle a claim that admits fault for us or puts an obligation on us without our written consent.
28. Disputes and governing law
28.1 Talk to us first
Before starting any formal dispute, email support@builtonfuture.com with a description of the problem and what you want. We’ll try to resolve it informally within 60 days. We’ll do the same with you.
28.2 Governing law
These Terms are governed by the laws of the State of Delaware, and the federal laws of the United States, without regard to conflict-of-law rules.
28.3 Courts
Any dispute will be brought only in the state or federal courts located in Travis County, Texas, and both of us consent to those courts’ jurisdiction. Both of us waive the right to a jury trial to the extent the law allows. Either of us may bring an individual claim in small claims court where it qualifies.
28.4 Time limit
Any claim must be brought within one year after it arises, where the law allows that limit.
29. Changes to these Terms and policies
- We may update these Terms, the Refund Policy and the Acceptable Use Policy. Each published version shows its date and version number.
- Material changes: we tell you by email and in the Studio at least 14 days before they take effect. If you keep using Future after that date, you accept the new version. If you don’t agree, you can cancel before then. For a prepaid plan, a material change that’s adverse to you applies from your next renewal, unless it’s needed for legal, security, fraud or abuse reasons.
- New sign-ups and purchases accept the version in effect at the time.
- A change never takes away a refund right you’ve already earned. The money-back guarantee in force when you paid for a new plan applies to that payment.
- The guarantee for future purchases: we may change or end the money-back guarantee for future purchases at any time, with notice on our pricing page. We may still refuse or reduce a refund for abuse or fraud (Refund Policy, Section 5).
- Changes to fees follow Sections 5.6 and 13.
30. General
- Whole agreement. These Terms (with the Acceptable Use Policy, the Refund Policy, and anything you agree to at checkout) are the whole agreement between us about the Service. If they conflict, the checkout terms for your purchase win, then the Refund Policy for refunds, then these Terms.
- Assignment. You may not transfer these Terms or a site to someone else without our written consent. We may transfer them in a merger, acquisition, reorganization or sale of assets, or to an affiliate.
- Events beyond our control. We aren’t liable for delays or failures caused by events beyond our reasonable control (for example outages of Third-Party Services, internet failures, attacks, natural disasters, war, or government action).
- Notices. We send notices by email to your account’s address or in the Studio. You send notices to support@builtonfuture.com and, for legal process, to our mailing address in Section 31.
- Electronic communications. You agree to receive notices, receipts and agreements electronically. Account and billing emails can’t be turned off while you have an account; marketing emails can.
- Severability and waiver. If part of these Terms can’t be enforced, the rest stays in effect. Not enforcing a right isn’t a waiver of it.
- Independent parties. We are independent contractors; these Terms don’t create a partnership, agency or employment relationship.
- Export and sanctions. You may not use the Service in breach of US export or sanctions laws, or if you are on a US government restricted list.
- Survival. Sections about payment owed, the limits on using the Future Design, your rights in Your Content and Your Logo, disclaimers, limitation of liability, indemnity, disputes and anything else meant to last survive the end of these Terms.
- Headings and “including”. Headings are for convenience. “Including” means “including without limitation”.
